Terms of Service

SiteShot is a daily reporting and field operations platform built for heavy civil construction crews. It is operated by Site Shot LLC, a limited liability company organized under the laws of Massachusetts ("SiteShot," "we," "us," or "our").

Our platform allows construction organizations to manage daily field reports, crew communications, safety briefs, equipment tracking, compliance records, and related operational data from a single place.

By accessing or using SiteShot — including our website at siteshot.ai, our web application, or any related services (collectively, the "Platform") — you agree to these Terms of Service ("Terms") and our Privacy Policy, which is incorporated here by reference.

If you are using SiteShot on behalf of a company or organization, you represent that you have the authority to bind that organization to these Terms. In that case, "you" refers to the organization.

3.1 Registration

To use SiteShot you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@siteshot.ai if you suspect unauthorized access.

3.3 Seats and Users

A "seat" is an active field user who submits reports through the Platform. Organization administrators and project managers are not counted as field seats unless they also submit field reports. You are responsible for managing access and ensuring that only authorized personnel have accounts in your organization.

3.4 Logo and Customer Reference Consent

By registering an account, your organization consents to SiteShot displaying your company name and logo on our website and in marketing materials as a customer reference. If you would like your logo removed, contact us at hello@siteshot.ai and we will remove it within a reasonable time.

3.5 Age Requirement

You must be at least 18 years old to create an account. SiteShot is not directed at individuals under 18.

4.1 Plans

SiteShot offers subscription plans billed on a per-seat basis. Current plan details, including pricing and features, are described at siteshot.ai/pricing. We reserve the right to change pricing with at least 30 days' advance notice to existing subscribers.

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method on the applicable billing cycle.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods, except where required by applicable law.

4.4 Failed Payments

If a payment fails, we will attempt to notify you. Access to the Platform may be suspended if payment is not received within a reasonable period after the due date.

4.5 Taxes

Subscription fees do not include applicable taxes. You are responsible for any sales, use, or similar taxes arising from your use of the Platform.

You agree to use SiteShot only for lawful purposes and in accordance with these Terms. You must not:

• Use the Platform to violate any applicable law or regulation

• Submit false, misleading, or fraudulent job site reports or data

• Upload or transmit malicious code, viruses, or any content intended to disrupt the Platform

• Attempt to gain unauthorized access to any part of the Platform or another user's account

• Scrape, reverse engineer, or copy the Platform's code, design, or data without our written permission

• Resell, sublicense, or otherwise commercialize access to the Platform without our written consent

• Use the Platform in a way that could damage, overburden, or impair our infrastructure

• Harvest or collect personal data from other users without their consent

We reserve the right to investigate and take appropriate action against any violation of this section, including suspending or terminating accounts.

6.1 Ownership

You retain ownership of all data, reports, photos, notes, and other content ("Content") that you or your team submit to the Platform. We do not claim ownership of your Content.

6.2 License to Us

By submitting Content to SiteShot, you grant us a limited, non-exclusive, royalty-free license to store, process, and display that Content solely to provide and improve the Platform for your organization.

​

6.3 Responsibility for Content

You are solely responsible for the accuracy, legality, and appropriateness of all Content submitted by you and your users. We do not verify the accuracy of job site reports, certifications, compliance records, or other data entered into the Platform.

6.4 Data Retention and Export

Upon cancellation or termination of your account, we will retain your data for a period of [30/60/90 days] during which you may request an export. After that period, your data may be deleted from our systems.

​

6.5 Aggregated Data

We may use anonymized, aggregated data derived from your use of the Platform for product improvement and analytics purposes. This data will not identify you or your organization.

The Platform — including its software, design, features, trademarks, and content — is owned by Site Shot LLC and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right or license to use our trademarks, logos, or proprietary software other than as necessary to use the Platform as intended.

If you submit feedback, suggestions, or ideas about the Platform, you grant us the right to use that feedback without restriction or compensation.

SiteShot integrates with third-party services to deliver its functionality, including:

• Twilio — for SMS-based crew onboarding and notifications

• Stripe — for payment processing and subscription management

• Resend — for transactional email delivery

• Supabase — for database and authentication infrastructure

Your use of these third-party services is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party service providers.

SiteShot is a tool, not a decision-maker. Every action taken as a result of data, reports, calculations, or alerts generated by the Platform is the responsibility of the qualified person who reviews and acts on that information.

SiteShot provides field reporting, scheduling tools, safety brief templates, compliance tracking, and field calculators to support — not replace — the professional judgment of superintendents, project managers, safety officers, and other qualified construction personnel.

The Platform does not:

• Verify the accuracy of information entered by field users

• Guarantee that safety briefs, inspection records, or compliance data are complete or legally sufficient

• Substitute for the professional evaluation of a licensed engineer, safety professional, or regulatory authority

• Automatically ensure regulatory compliance with OSHA, DOT, state, or local requirements

• Make autonomous decisions about job site operations, crew deployment, or equipment use

You and your organization are solely responsible for:

• The accuracy and completeness of all data entered into the Platform

• Reviewing, verifying, and acting on reports, alerts, and recommendations generated by the Platform

• Ensuring that field operations comply with all applicable laws, regulations, and safety standards

• The professional judgment applied to any decision made using information from the Platform

Site Shot LLC is not liable for any injury, loss, regulatory violation, or adverse outcome arising from a user's decision to act — or not act — on information presented in the Platform. The Platform is a productivity and documentation aid. The human running the job is responsible for the job.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SITESHOT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of security vulnerabilities. We do not warrant the accuracy of any reports, calculations, compliance data, or other content generated through or submitted to the Platform.

Note: SiteShot is a field reporting and operations management tool. It does not constitute legal, safety, engineering, or regulatory compliance advice. You are responsible for ensuring that your operations comply with all applicable laws and regulations.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SITESHOT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SITESHOT IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless Site Shot LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your Content; or (d) your violation of any applicable law or the rights of any third party.

13.1 By You

You may terminate your account at any time by cancelling your subscription through your account settings or by contacting us at hello@siteshot.ai.

13.2 By Us

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law.

​

13.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and governing law — will survive.

These Terms are governed by and construed in accordance with the laws of the State of Massachusetts, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Platform will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings conducted in Woburn, Massachusetts. You waive any right to a jury trial or class action with respect to any such dispute.

​

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, notify you by email or in-app notice at least 14 days before the changes take effect.

Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Platform and cancel your subscription.
